Waiver of inheritance in a different country (Reg. Ue 650/2012)
The Waiver of the inheritance made by an heir before a court of his State of residence is valid even if it does not comply with the formal requirements provided for by the law applicable to the succession in another Member State. This was ruled by the Court of Justice of the European Union (judgment of 2 June 2022 (C-617/20) with which it was clarified that Article 13 of EU Regulation no. 650/2012 admits an alternative forum of jurisdiction to allow the heirs to accept or renounce the inheritance without contacting the body of another Member State competent for the succession.
